Attorney Fees—Frequently Asked Questions

Attorney fees are typically paid separately by each spouse.

The court may order one of the parties to pay part of the attorney fees and court costs of the opposite party upon a proper showing of need by the requesting party. Need is typically shown by a spouse who is not working, or where there is a great disparity in earnings between the spouses. Attorney fees are not routinely granted, as judges have found this to be a volatile issue in divorce cases.
